Agitation Programmes of Forum of BSNL Unions / Associations will continue since
the discussion with CMD, BSNL failed:
Today GS, President along with the representatives of Forum of BSNL Unions and
Associations attended the meeting with CMD, BSNL. Director (EB), Director (Finance), PGM(SR), GM(Estt.), GM(CA), DGM(SR) and
AGM(SR). CMD, BSNL welcomed the representatives and asked to discuss about the demands. The representatives of Forum one by
one resented and strongly demanded the implementation of DPE orders dated 26th Nov'2008 and 2nd April'2009 and revision of
allowances as per 2nd PRC recommendations and 78.2% IDA fitment benefit in the pay respectively . They also protested against
the discriminatory attitude of the BSNL Management wherein Management has issued order for payment of all the allowances and
pay fixation order to un-absorbed ITS Officers as per 6th CPC recommendations. CMD after hearing all the representatives of
Forum accepted that they don't have much to discuss today but the demands of Forum can be accepted, only when the company's
financial health improves, till the time employees should have patience. Forum leaders categorically told that since BSNL
Management is giving all 6th CPC benefits to non-optee ITS Officers and providing vehicles (SWIFT Dzire, Maruti SX-4, Honda
City etc.) then how management is pleading financial implications for BSNL absorbed employees.
Hence, Forum of BSNL Unions/Associations after CMD's Meeting in its meeting decided to continue
proposed agitation programmes i.e. DHARNA on 6th June'2012 and Indefinite strike w.e.f. 13th June'2012 .
All the Circle Office Bearers / CWC Members / Divisional Office Bearers and activists are requested
to mobilize from nowitself to make the agitation program a successful. All the members are requested to participate in the
agitation program and make it successful.

The order issued by DFA HQ-II regarding surrender of BSNL articles on retirement kept under
abeyance until further instructions. We addressed a letter to CGM,CHTD on 25.05.12 to withdraw / amend the letter issued
by the finance wing. Our stand is vindicated.

CP,CS,CTr,AS(S) and CEC Member Com.Ganesan attended the felicitation function of Com.
R.Gopalan AGM Chromepet, held on 29.05.2012. Com.R.Gopalan is retiring on superannuation on 31.05.2012. All the members appreciated
the unbiased attitude and co-operation extended by Com.R.Gopalan during his tenure as AGM at Chromepet. Com.R.Gopalan
was very much associated with trade union activities from the early days of his service. Despite pressures from various
quarters he never deserted SNEA(I). We wish him a peaceful and healthy retired life.

Send ITS to the barracks by 30th Sept: – Decisive and conclusive phase of struggle inevitable to begin
a new era from 01st Oct: ‘12, the 12th birthday of BSNL. The Hon Delhi High Court in a landmark judgment recently
directed the applicants (ITS as well as ITSA) to exercise their option for BSNL/MTNL /DOT within two weeks from the date of
judgment, also directing BSNL/MTNL managements to relieve those not opting for BSNL/MTNL in next two weeks. Hon Court partially
accepted their prayer for prospective absorption from 08.12.2005, thus giving fourth option to the ITS to get absorbed, first
in 2005, then in 2008, and third time in 2011. In between SLD R/R was also notified practically accepting all inconceivable
demands of ITSA such as pension under Rule 37, inter-se-seniority and pay protection etc. Despite all these concessions in
total contravention of established rules of DOP & Trg and DOP&P(W), ITSA strongly advocated against applying for senior
posts in BSNL to torpedo the absorption process and thereby once again reiterate their hidden agenda to continue in BSNL only
as lords on deputation. This once again explicitly exposes and establishes their diabolical standard and blackmailing tactics
- on the one hand setting impossible demands to get absorbed, and, on the other, defeating the entire process even after all
such demands are met. After 5 years of deputation, the maximum permissible limit for deputation which ended on 01.10.2005,
the issue continues to linger on for last 7 years without any legal sanctity and justified grounds. The intentions of the
CMD and the BSNL Management stand nakedly exposed with the BSNL/MTNL going to the Hon Delhi High Court seeking 25 months time
for repatriation, an utterly shameful and ridiculous move to protect the fraternal vested interests of ITS at
the cost of the Company. Although collusion between BSNL management and ITSA is a foregone conclusion, yet, this, perhaps
is the first time that we witnessed such shameful and naked collusion between BSNL Board and ITS, reinforcing and exposing
our firm belief that the BSNL Management and ITSA is a single entity committed to destroy BSNL and reduce it to ashes. Given
categorical and unequivocal commitment of CMD that the entire ITS absorption process would be completed by 31st March 2012,
we along with AIBSNL EA and BSNL EU, were left with no other option but to legally oppose tooth and nail shameful and unpardonable
move of CMD to seek extension of 25 months for repatriation. Even though Hon Court did not admit our impleadment application
on technical grounds, yet our arguments vehemently opposing extension of time were given due consideration. Finally Hon Court
disposed off the BSNL application with clear directions to complete the repatriation process by 30th September, 2012, even
rejecting Management’s desperate plea for time up to 31st December. Now almost all the legal options are closed for
both ITS and the BSNL Management. But established conspirators, BSNL management and ITSA, can collude to stretch the
issue and go to any extent to defeat the process. With entire developmental activities and monitoring mechanism
having come to a standstill and grinding halt and Company crumbling very fast, Comrades, we cannot allow 1000 tyrants supported
by callous management to hold 2.75 lakh employees and the Company to ransom. History will never pardon us if we do not rise
to the occasion and stand up erectly to take on the onerous responsibility on our shoulders, either by commission or omission. Every
struggle needs a price to be paid and we should be ready for sacrifice as we have done in the past. Already, CMD has started
taking series of vindictive actions against us for our bold stand on the issue of absorption. One such glaring instance is
recalling of the file, immediately after our impleadment in Hon’ble High Court, to fill up 414 posts of DGMs, even though
it was already approved by the MC, and sending it to finance wing on frivolous grounds to examine financial implications.
Giving transport allowance, children education allowance, foreign training allowance and what not at central government
rates to unabsorbed ITS and denying us 78.2% legitimate IDA, snatching away from us meager medical reimbursement, imposing
moratorium on LTC etc is nothing but deplorable, shameful and condemnable. We should get ready to fully expose BSNL management’s
meek acts on the streets and never think for a moment the impact of our tough stand on our cadre issues. We have faced and
defeated such threats in the past with great determination and conviction. CMD may stoop as low as going to the extent of
stalling our DPCs, but that should hardly matter since nothing is precious to us than safeguarding our Beloved Company.
The ‘wolf’s cry’ that heavens will fall on repatriation is lost in the din. The only responsible and
sensible option for CMD is to go in for outside recruitment and that too after complete repatriation and redeployment of all
the unabsorbed ITS. The message should be loud and clear. Blackmailing can be put to an end after initiating outside recruitment
only once all unabsorbed ITS are repatriated since absorbed officers are available in abundance to take the responsibility.
Meanwhile massive restructuring work should be undertaken and all the SSAs having less than 1 lakh DELs are immediately downgraded
to TDM/TDE posts. As of now SSAs with 10,000 DELs as well as 4.5 lakh DELs are headed by GM. We would like to warn CMD
and the board of directors of the grave consequences they shall to face for playing into the hands of vested interests and
in the process allowing company to collapse. CMD is playing with fire by ignoring the orders of DOP&Trg declaring the
promotions given against the posts of BSNL to unabsorbed ITS illegitimate, orders of DOP clearly stating that deputation period
cannot exceed six years, orders of DOP&P(W) declaring their pay protection illegitimate, verdict of CAT/ND to repatriate
them, verdict of Honble Delhi High Court directing BSNL management to relieve unabsorbed ITS by 17th May,12 and orders of
DOT repatriating them en masse. CMD is carefully playing to the hidden agenda of ITS to allow them to continue on deputation
and is making all out efforts in this direction ignoring the deadly repercussions of his move on the future growth and viability
of the Company. Comrades, this is the right opportunity and perhaps the last opportunity for us to strike and save BSNL
from complete disaster. Let us rise to the occasion and make serious and all out organizational preparations to start a decisive
and conclusive struggle that culminates in repatriation of all unabsorbed ITS by 30th Sept.,12 and thus paves the way for
beginning of new era that coincides with 12th anniversary of formation of BSNL. Let us not look back and respond to the clarion
call of the CHQ to respond to the situation with unprecedented courage, conviction and determination. But remember the foes
are more wounded and terribly desperate because they do not want to leave the kingdom of BSNL come what may. They know what
it means leaving kingdom Raj and going to the surplus cell. They can go to any extent to stay in BSNL (their hidden agenda)
on deputation and management will also go to any extent to meet their sinister agenda and that makes our struggle all the
more challenging.
An emergency meeting of all Unions/Associations in BSNL was held at New Delhi today at 1500 hrs to take very
serious note of the brazen faced order issued by BSNL Management on 25.05.2012 to grant following 15 new allowances recommended
by 6th CPC to the unabsorbed ITS officers whose repatriation orders are issued by DOT and who have been ordered to be relieved
from BSNL by 30th Sept., 12 by Hon Delhi High Court. 1) Transport allowance, 2) Children Education Assistance &
Reimbursement of Tuition fees, 3) Family Planning Allowance, 4) Special Allowance for child Care to women with disabilities,
5) House Rent Allowance, 6) TA & DA while on official tour, 7) DA on foreign tour, 8) Training Allowance, 9) Other
Allowance like (i) Special Duty Allowance, (ii) Special Compensatory (Remote Locality) allowance/Tribal Climate Allowance,
(iii) Hill area allowance, (iv) Tribal Area Allowance, (v) Island Special Duty Allowance and (vi) Hard Area Allowance.
This results in crores of rupees expenditure to the BSNL. Utterly shameful as it is on BSNL management, on one hand it
is giving all the concessions to unabsorbed ITS, and, on the other, it is denying implementation of legitimate orders of Govt/DPE
such as 78.2% IDA fixation w.e.f 01.01.2007, perks, antedating of increment for non executives/Executives etc. Not only that,
shameless BSNL management has withdrawn medical allowances/ LTC, bonus etc for employees of the Company.
In view of the above the meeting of all the unions/Associations unanimously decided to go for spontaneous trade
union actions to give a befitting and ruthless reply to brazen faced and irresponsible BSNL management whose only agenda is
to work towards ensuring perpetual deputation of ITS in BSNL. Extending all these allowances to ITS will not only involve
expenditure of thousands of crores but it is a well calculated move to finally allow ITS to continue in BSNL on perpetual
deputation. BSNL management is working to meet this sinister agenda of ITS. People having no affinity, interest and involvement
in revival of BSNL are being patronized because of narrow considerations.
This adequately establishes that BSNL Management is not at all interested in financial viability of the company.
Instead, it is fully committed to appease and safeguard interests of unabsorbed ITS at any cost.
Comrades, get ready for a do or die fight. Get ready to shed each drop of blood to safeguard our dignity and
our Beloved Company. We cannot accept this humiliation under any circumstances.
Demands:
1. Immediate payment of 78.2% IDA fixation to the nonexecutives and Executives w.e.f 01.1.2007.
2. Immediate restoration of medical allowance, LTC and leave encashment.
3. Payment of Bonus, Revision of Transport allowance and other perks and immediate settlement
of all other demands kept pending because of financial implications.

The Central Area General Body Meeting was held on 23.05.2012 at Anna Road Exchange complex.
It was unanimously decided in the meeting that we have to protest the transfer order issued by the administration
on the basis of the proposal sent by DGM(C) /Sr.GM(C). Comrades be prepared for the agitation,
if the issue is not resolved and let us not allow the administration to issue such a type of transfer order violating the
BSNL CO transfer policy. SNEA(I) is not against transfer of executives, whether it is to next street or to a far away
place. We will not allow the administration to issue such a type of transfer order based on the arbitrary proposal of DGMs/GMs.

Road Exchange Complex on 23.05.2012(Wednesday) to discuss on the orders transfering some Executives in central area.
All the Central Area COBs/CEC Members/Divisional Office Bearers and the Members of Central Area are requested to attend
without fail.

CP,CS and ACS com.M.K.Veerapandian met GM(HR&Admn) and discussed the following issues.
- Delay in conducting the left out TBP DPC.
- Local officiating in the cadre of SDEs/DEs/DGMs.
- Clearance of request transfers in all cadres and requested to give priority to clear
request transfer on medical ground.
- Cancellation of transfer order issued by the adminstration; simply regularising
the transfer order issued by DGM(NWO-C) without following any norms.
GM(HR&Admn) in his reply stated that the DPC for the available cases will be conducted
during next week and the remaining pending cases will be completed soon. Officiating arrangements in all the cadres are under
process and orders will be issued shortly. While discussion on the regularization of transfer orders issued by the DGM(NWO-C),
we have told that a letter was addressed to CGM on 27.04.2012 regarding the transfer of executives. In that letter
we have clearly mentioned that the DGM(NWO-C) has whimsically chosen the executives and transfered without following
any norms. Now the administration has simply endorsed the proposal sent by the DGM(NWO-C)/ Sr.GM(C) without
any study. We have stongly objected the move of the administration by issuing such a type of transfer orders without
studying the proposal sent by DGMs/GMs. Instead of following the well devised BSNL transfer policy,
the administration on recommendation of some DGMs/GMs are issuing transfer orders in violation of BSNL transfer policy.

CP,CS and ACS Com.M.K.Veerapandian met DGM(HR&A) and discussed the following issues
- Delay in conducting the left out TBP(E1 to E2 onwards) DPC.
- Local officiating from JTO to SDE; SDE to DE and DE to DGM. It was informed to DGM(HR&A)
all the eligible JTOs should be covered in the officiating list.
- Consideration of request transfer cases while issuing officiating orders.
DGM(HR&A) during the discussion said that the pending TBP cases will be settled soon. DPC will
be arranged during next week for the CR and DCC available cases. Officiating arrangements for all the cadres are
under process and informed that request transfers will be considered to the extent possible.

All the Executive Associations' Circle Secretaries were called for discussion on staffing
norms in External units on 08.05.2012 and the meeting was chaired by GM(HR&Admn). On the same day afternoon Opinion Leaders
meet was held under the chairmanship of CGM and the subject was "Marketing of Mobile products by all".

Heartiest congratulations Comrades!
Honble CAT Chennai dismisses OA 36/2011 filed by AIGETOA challenging preparation of all India
eligibility list for promotion from JTO to TES Gr B on the basis of guidelines of DOT. Association fought the case legally
tooth and nail by engaging learned and senior counsel at Chennai. Committed and tireless efforts of the Association to get
the stay on holding of DPC from JTO to TES Gr B vacated so as to pave the way for holding of DPC from JTO to TES Gr B produce
desired results. SNEA(I) was the only Association to get impleaded in the case to get stay vacated. What has to be appreciated
is that this Association has been consistently and singularly taking very positive, concrete and timely actions to remove
legal hurdles created in holding of DPCs from one cadre to another so as to facilitate expeditious holding of DPCs for quick
functional promotions.
Our profound concern is to ensure that younger Comrades get functional promotions as quickly
as possible and that can be accomplished only by holding of DPCs expeditiously, not blocking of DPCs. Creating legal hurdles
to block DPCs blocks the career aspirations of younger Comrades. Holding of DPC from JTO to TES Gr B will surely clear the
decks for functional promotions of young Comrades.
Com.G.L.Jogi President SNEA(I) during his visit to chennai met our Senior Advocate and gave
valid inputs for the case. Com.K.Sebastin GS and Com.A.A.Khan have provided the important documents regarding the case in
time, which has yielded the result. Com.N.Chitti Babu President, Com.B.Srinivasan VP,Com.M.K.Veera Pandian ACS were fully
associated with CS for all the time and the efforts taken by them is laudable.
On the day of pronouncement of Judgement none from the applicant side was present.
