New Pay scales

BSNL CO issued clarification on the Pay Fixation for Executives joined after 1.1.07, Executives whose increment is due in the month of January etc

DPE issued orders for Revision of pay scales w.e.f  01.01.2007 as per the decision of the Cabinet for all Executives in the Central Public Sector Enterprises (CPSEs)

The cabinet, headed by Prime Minister, approved a proposal to merge 78.2 per cent of dearness allowance (DA) with basic pay as against the 68.8 per cent DA merger announced in November last year as recommended by GoM. As a result, the total emolument on a basic pay of Rs. 100 would become Rs. 231.66 after considering 30 per cent fitment on basic pay plus DA and differential pay (DP). In the previous decision, this came to Rs 219.4. HRA will be effective from the date of issue of order by DPE i.e 26.11.08.

Ceiling on Gratuity

As recommended by the 2nd Pay Panel, Govt. enhanced the ceiling on gratuity to 10 lakhs and DPE issued the orders on 26-11-2008. The file in this regard sent by DoT to Dept. of Pension was cleared by DoP. Now DoT will issue suitable directions to all the DoT cells enhancing the ceiling to 10 lakh. It is also learned that DoP approved it w.e.f 01-01-2006 onwards.  

 

LDCE SDE Posting

GS SNEA(I) and GS, AIBSNLEA along with other CHQ office bearers met DIR(HRD) and GM(P) and strongly protested against the arbitrary modification order issued in LDCE posting without following any criteria on a pick and choose method. Association strictly demanded implementation of criteria based transfer and posting of officials. DIR(HRD) agreed to review the entire pending cases

EPF scheme to JTOs

The JTOs of 2007 batch has to carefully exercise the option for EPF. Some important points are given below for your guidance. Each employee (JTO) has to give a

1.Joined declaration signed by the employer as well as the employee has to be submitted to the EPF authorities as the contribution is done without the statutory ceiling of Rs. 6500/-.

2.There is an option for the employee to opt for minimum pension scheme or Full pension scheme. Each employee has to exercise this option carefully as in minimum pension scheme, employee will get only a small amount as pension where as in full pension scheme the employee will get very good pension as good as Govt. pension and a good amount as provident fund contributed by the employer in addition to the employees contribution. An amount equivalent to 12% of emoluments (basic +IDA) will be deducted from the salary as the employees contribution towards provident fund. BSNL will contribute 13.61% of emoluments to EPF of which 8.33% will go to pension fund and 3.67% will go to the provident fund account. In minimum pension scheme employee will get a very good amount as PF at the time of retirement. So those who are interested in bulk amount as retirement benefit, they can opt for minimum pension scheme and those who are interested in good pension they can opt for full pension. Even in full pension scheme there is a provision for commutation of pension (85%).

          The beautiful city of Vadodara in Gujarat hosted XXVII AIC of SNEA (India) during 14-16 December 2008. The massive hall at Satyam Shivam Sundaram Complex accommodated more than 1000 delegates  with comfort and ease. From Chennai Telephones twenty nine delegates participated in the AIC.

          The delegate session was inaugurated by  Smt. Jayaben Thakkar MP Vadodara in the presence of  Shri Rajendra Singh Director (Commercial & Mktg), Shri Satya Pal CGM Gujarat, Shri Ramakant Sharma PGM, Vadodra, Com Rakesh Pande Chairman NTPC Executives Federation of India and Convenor of CCCOPSU on 14-12-2008. At the end of the lively address of MP, Com GS urged MP to raise issues concerning BSNL in parliament. He indicated that it is the fundamental duty of MPs to safeguard the growth of Govt PSUs in the interest of our country, as consistent attack has been unleashed on PSUs by Govt and regulator through their negative policies leading to non creation of level playing field. He asked, ‘Why there is no accountability for top management ?’  He lamented that senior management is not part of the organisation.

          The grand Open Session was inaugurated by Hon'ble Chairman & Managing Director BSNL Shri Kuldeep Goyal, CGM Gujarat Shri Satya Pal in the presence of senior officers of Gujarat and Vadodara on Dt.15-12-2008. More than 1500 executives attended  Com A K Kaushik GS TEAM MTNL, Com Tomar GS MTNL Executives Assn Delhi, Com Prasad GS  MTNL Executives Assn Mumbai, Com Prahalad Rai GS AIBSNLEA and Com W Seshagiri Rao President NCOA addressed. All the veteran leaders highlighted the issue of ITS absorption and Financial Viability of BSNL. The slogans like ‘NO MT’ and ‘Send ITS out’ reverberated in the hall

XXVII AIC at Vadodara

     The AIC started with Pre AIC CWC on 13th Dec 2008 at Hotel Tulsi. The report of the GS elaborately covering all the activities during the period from Jan 2006 to Dec 2008  was adopted with minor modifications after some intense deliberations. The General account and TEC account were also adopted in the CWC.

     On 14th Dec 2008 morning Com S L Reddy CHQ president hoisted our flag in the presence of Com G L Jogi GS amidst slogans raised by comrades. The delegates paid homage in memory of departed comrades and for victims of Mumbai blasts. The AIC also passed the GS report as adopted by CWC. The house also adopted audited accounts presented by Com H Muthu Treasurer. The inaugural session was on the same day. The grand open session was on 15th Dec 2008.The deliberations were done on the following items of agenda. Twenty nine delegates from Chennai actively participated in all deliberations.

Issues Taken

While Chennai metro comrades are enjoying 30% HRA the comrades of adjoining districts with high potential for growth and development the comrades are toiling hard with heavy financial loss due to meager HRA. It is high time this aberration is removed by BSNL HQ, as for all practical purposes Greater Chennai is treated as a single unit and ensure uniform 30% HRA is given to Greater Chennai. A strong resolution is to be passed in this AIC to settle this long pending issue. As per the call of our GS our comrades started moving into these unpopular areas to ensure growth and their grievance is to be redressed on priority basis

On financial viability our delegates touched the issues of redundancy in procurement of equipments, data center location on lease, improper filtering of frequencies by private GSM operators leading to interference in our spectrum, problems in broadband provision and maintenance

MTRR and Group A Rectt Rules draft require much attention and alteration

Retrospective seniority fixation in TES Grp B. Here we find the DOT Secy was misled by BSNL by suppressing many facts relating to the CAT Chennai and Chennai High Court judgments

The issue of cash collection in CSCs by engineering executives in cities like Chennai is another major problem in Chennai

CEC on 5th Dec 2008

   CEC Meeting was held on 5th Dec 2008 at SNEA Bhavan to discuss finalise the issues for AIC.

   The issue of posting of all JTOs on promotion to SDE to CPT SSA came up for discussion in CEC. After elaborate deliberations the CEC approved the decision to post JTOs on promotion to CPT SSA on promotion in the overall interest of BSNL as shortage of SDEs  in CPT SSA was more than 50 % and also in the interest of our comrades of CPT SSA as the waiting list of transfer to Chennai has been cleared and the long pending demand of CPT SSA comrades have been fulfilled. We were able to set the trend that the executives working in CPT SSA can return to Chennai on transfer. It was also decided to reimburse 50 % of Delegate Fees (Rs 500) from Circle

Repatriation to DOT

United Forum of BSNL & MTNL executive associations has unanimously resolved on 23rd October 2008 to seek immediate repatriation of BSNL & MTNL executives to DoT from BSNL & MTNL. This decision of the United Forum has been taken after extensive deliberations over the dual policy of the govt. & BSNL/MTNL on the issue of absorption which has shaken the very foundation of viability of BSNL & MTNL. Earlier Joint Forum of BSNL Unions/Associations of  Non executives and Executives passed a similar resolution.

 

United Forum has given a call for Trade Union action on this crucial issue. It is the duty of every executive to make these programs a grand success and exhibit our unity and solidarity. It is pertinent to watch  the unity and solidarity of  ITS cadre who stand united solidly under the banner of ITSA to safeguard their interest.

Retrospective Seniority fixation

     DOT gave retrospective seniority to 270 TES Gr B against competitive quota in the year 2001 on the basis of what we gathered was Judgment of CAT Bangalore. In fact, retrospective seniority to competitive quota was given prior to 2001 also. On challenge, this retrospective seniority of 270 SDES was set aside by CAT Madras against which DOT filed writ petition in Chennai High Court in 2001. Chennai High Court set aside the writ petitions of DOT in the year 2008, upholding the Judgment of Chennai CAT delivered in 2001. When the Judgment of Chennai High Court was challenged in Supreme Court, it directed DOT to maintain status quo. The case is now pending in Supreme Court where it is expected to come up for final hearing shortly. In the meanwhile, DOT published provisional seniority list of about 147 TES Gr B officers having appeared in the qualifying cum competitive examinations in the years 2000 and 2003 according to the directions of Ernakulan High Court, extending them also the principle of retrospective seniority on the lines of 270 SDEs in 2001.

     Immediately after the provisional list was issued in respect of 147 SDEs, and Supreme Court directed DOT to maintain staus quo with regard to Judgment of Chennai High Court, we had very close and prolonged interactions with the concerned officers of DOT and pleaded with them not to finalize the provisional seniority list of these 147 SDEs till disposal of the case in Supreme Court. Our argument was that since these 147 SDEs have been given retrospective seniority by extending the principle of 270 SDES, and since retrospective seniority of 270 SDEs is under challenge in Supreme Court which has directed maintaining of status quo, it would be appropriate for DOT to wait for the final outcome of the case in Supreme Court before finalizing the provisional seniority of 147 SDEs. The concerned officers of DOT assured us

of seeking comprehensive legal advice in the matter before finalizing the provisional seniority of 147 SDEs. Accordingly, the file containing the entire background of the case along with all the relevant Court Judgments was sent to the legal advisor of DOT who is a Jt/Secy level officer from ministry of law. Legal Advisor/DOT, we were informed, suggested going ahead with finalization of the provisional seniority of 147 SDEs, and final seniority list of these 147 SDEs giving them retrospective seniority was issued by DOT. Out of these 147 SDEs, about 50 have been promoted to adhoc STS very recently.

After all these developments, the Association has decided to file an impleading application in Supreme Court where the whole issue particularly the very basic principle of deciding whether retrospective seniority fixation extended to 270 SDEs and subsequently to 147 SDEs is justified or not is going to be adjudicated. The Association has already collected necessary documents and handed over the same to our lawyer who shall very shortly be filing an impleading application in Supreme Court. All the relevant facts in support of the adversely affected SDEs shall be placed before the Supreme Court. We shall have to wait for the final outcome of the case in the Supreme Court. [This stand was taken by CHQ as a sequel to the GB at Chennai addressed by GS and his promise in the GB to implead in court]

Restoration of Seniority

of 1966 SDEs

       Our CHQ laid stress with the management for early restoration of the restoration of Seniority of 1966 SDEs in line with the Hon’ble Court's judgment. The total work relating to seniority has been transferred to AGM(DPC). Necessary draft for restoration of 1966 SDEs seniority has been prepared and put up.  Management is also positive in this direction.

TES Grp B Competitive Quota Promotion Orders issued

    On 3rd Nov 2008 BSNL promoted 1684 JTOs as SDEs under competitive quota. Most of the JTOs were retained in parent circle on promotion. In Chennai 27 JTOs have been promoted , 22 JTOs are allotted Chennai TD. We congratulate all of them. It may be recalled that CGM CHTD wrote to BSNL HQ requesting to post all to Chennai considering the developmental activities in Chennai especially CPT SSA. When the administration decided to post all to CPT SSA citing the reason for growth and shortage of manpower in CPT SSA, we could not protest much as we are equally concerned with the growth and welfare of BSNL. Moreover no one was prepared to work in CPT SSA either on transfer or on officiating basis even with HRA protection. The administration called all executives associations in this regard. The other two associations also did not protest the policy decision of administration. However when the proposal of posting them all to fill up 15 new posts and to give relief to some SDEs who have applied for transfer to Chennai was informed to us, we suggested that once all the 22 promotes are to be utilized in CPT SSA, relief should be given to all 15 SDEs who are waiting for many years to come to Chennai. By doing so relief can be given to SDEs of CPT SSA and the request transfers of SDEs in Chennai can also be considered. We also suggested transparency should be maintained in posting. This proposal was accepted and accordingly counseling was done for all promotes on 7th Nov 2008. Counseling will be done while posting in case of request transfers also. Meanwhile ten promotes met CS on 12th Nov 2008 and expressed their concerns regarding HRA and transfer back to Chennai. CS urged them to take this as a challenge and improve growth and assured them that efforts will be taken to get HRA on par with Chennai and they will be brought back to Chennai at the earliest.

Payment of Arrears of stipend on switch over to IDA pattern

   The training stipend for the JTOs during the period of their induction training was changed from CDA based to IDA based pattern (Rs. 6895 + IDA as applicable) w.e.f. 01-01-2005 vide this office letter No. 16-1/04/Trg dated 31-12-2004.

    The JTOs who have undergone their induction training before 01-01-2005 and who were paid training stipend during their induction training in CDA based pattern will be eligible to draw their respective arrears on IDA based pattern (Rs. 6895+ IDA as applicable) on account of the above decision of the BSNL Management Committee.

   3141 JTOs have been recruited by BSNL through competitive exam. Chennai Telephones have been allotted 34 JTOs. We welcome them !

STS Promotion re allotment

  Some more re allotments have been issued by BSNL HQ in respect of promotion to STS and comrades have joined Chennai TD. We met DGM A and impressed upon him to fill up STS vacancies in Chennai with senior comrades who have been re allotted to Chennai. Two of our comrades have been posted in Chennai. Other comrades have been posted in CPT SSA

CSC Cash Collection issue

   In a CSC committee meeting with DGM A on 23rd Oct 2008 the issue of cash collection was taken up and our stand was explained. It was highlighted that cash collection should be supervised by accounts personnel only. We have earlier taken up this issue with CGM also.

Preparation of Gr.A RRs

   CHQ impressed upon GM(Personnel) to fully incorporate the decisions that have been taken in the joint committee of BSNL Management and the United forum of executives. CHQ reiterated the crucial decisions taken by the Joint Committee like integration between promotee STS and MTs at JAG in the ratio of 1;1, filling up of 50% STS posts on regular basis by TES Gr B and equivalent and the remaining on adhoc, regularization of existing adhoc STS to the extent of 50% of posts of STS, granting of necessary relaxation to regular STS in terms of requisite qualifying service for regular promotion to JAG etc. GM(Personnel) assured that the memoranda of understanding between the United forum and BSNL Management would be fully upheld and all the above cited important decisions would be incorporated while finalizing Gr A RRs. The draft of the same has already been prepared. Efforts are on to get it approved in next Board meeting.

Spectrum Issue

Hon’ble High Court of Delhi has issued notices to the Union of India asking it to explain as to what first come first serve policy means, for allocation of 2G spectrums to about 121 applicants, many of them are real estate developers, on a price decided in 2001. Delhi High Court has issued notices to the Union of India on a PIL. SNEA was the only forum in BSNL to raise the issue of arbitrary allocation of 2G spectrum and loss of about 50,000 crores to the exchequer effectively. Swan which obtained 2 G spectrum at a throwaway price of 1651 crores is today valued at more than 8000 crores by selling its 45% equity to Etisalat of UAE.

   Com President and Com CS met new GM(O) Sri Paramanandam on 17th Oct 2008 and discussed the issues taken up in CEC. The issue of wasteful expenditure of printing of hand outs for AOs by RTTC MMN was taken up and it was put on hold

Works Committee Meeting

    The first works committee meeting was held at Conference Hall CGM(O) on 15th Oct 08. CS and all other union representatives participated. CGM explained the purpose of the works committee. Works Committee will invite purposeful suggestions for improving sales ,growth & profit.
